PLEASE READ THIS AFFILIATE PROGRAM AGREEMENT CAREFULLY.

This is a contract between you (the “Affiliate”) and Studio Bernhard keramika, Borut Cafuta s. p., Podbreznik 15, 8000 Novo mesto (“NetiYoga” or “we” or “us”). It outlines how our affiliate program operates and sets forth the obligations and terms of the business relationship. Participation in our affiliate program implies acceptance of these terms.

We reserve the right to periodically update these terms. If updates are made, we will notify you via email or other electronic means. Continued participation after such changes implies acceptance of the updated agreement.

Definitions

• Affiliate Program: The program allowing participants to earn commissions by referring customers to NetiYoga.
• Affiliate Link: A unique tracking link provided to the affiliate.
• Customer: A person who makes a purchase through the affiliate link.
• Commission: The percentage paid to the affiliate for each valid customer transaction.
• Lifetime Cookie: Permanent tracking for customers who refer 3 leads; non-customer leads are tracked for 30 days.
• Affiliate Dashboard: A portal where affiliates can track performance and commission status.

Program Overview

At NetiYoga, we reward affiliates who help us share our handcrafted neti pots and wellness products. Whether you are a customer or non-customer, our affiliate program allows you to earn commissions for successful referrals.

For Customers:

• Enrollment: All customers are automatically enrolled in the affiliate program.
• Lifetime Cookie: Referrals are tracked permanently until 3 leads are referred.
• Commission: After 3 leads, you earn 10% commission on future referrals.

For Non-Customers:

• Application: You can join by filling out the registration form. Once approved, you receive a unique affiliate link.
• Cookie Duration: Non-customer referrals are tracked for 30 days.
• Commission: Earn 10% commission on each sale after the 30-day refund period.
• Payout Threshold: Minimum payout is €50 via PayPal.

Tracking and Commission

1. Commission Rate: Affiliates earn a 10% commission on every valid sale through their affiliate link.
2. Lifetime Cookie for Customers: Once 3 new leads are referred, customers receive lifetime tracking.
3. 30-Day Cookie for Non-Customers: Non-customers have a 30-day cookie for referrals.
4. Payouts: Minimum payout threshold is €50. Payments are made via PayPal.
5. 30-Day Refund Period: Commissions are paid after a 30-day refund period to ensure no returns are made.

Affiliate Responsibilities

• Affiliates may not engage in any misleading or unethical marketing practices, such as cookie stuffing or incentivized clicks.
• Affiliates are strictly prohibited from bidding on branded keywords, particularly [netiyoga], in Google Adwords or other advertising platforms.
• Affiliates must accurately represent NetiYoga products and brand.

Lead Acceptance Criteria

• We reserve the right to reject any affiliate lead if the customer is already in our system or actively engaged with NetiYoga.
• Commissions will not be paid for any lead determined to be fraudulent or resulting from prohibited practices.

Data Protection

We comply with GDPR regulations. Personal data collected for the affiliate program will be securely processed and used strictly for program-related purposes.

Term and Termination

1. Termination without Cause: Both parties may terminate this agreement with 15 days’ written notice.
2. Termination for Breach: If any misuse or violation of terms is detected, NetiYoga reserves the right to immediately terminate the agreement.
3. Effects of Termination: Upon termination, the affiliate will stop using the affiliate tools, remove all references to the program, and cease using the affiliate link.

Governing Law

This agreement is governed by the laws of Slovenia.
